Another prohibited practice under Article 5 of the AI Act is exploiting vulnerabilities of specific groups. The Act explicitly calls out using AI to target people based on vulnerabilities tied to their age, disability, or socio-economic situation, in ways that distort their behavior and cause harm. This provision is clearly meant to protect groups like children or the elderly from AI-driven manipulation that takes advantage of their vulnerability. For instance, an AI toy that slyly pressures children to make purchases (or influence their parents to) could be seen as exploiting a child’s credulity – something the AI Act would ban.
It’s important to note that the AI Act’s prohibitions require a “significant harm” threshold. This means not every little nudge by an AI is illegal – the law is targeting the worst forms, like truly covert or coercive manipulation with serious consequences. Still, the fact that the EU is banning any AI manipulation at all is remarkable. It signals a recognition that some AI-powered persuasion tactics are beyond the pale.

The Digital Services Act: Transparency and User Choice

Complementing the AI Act, the Digital Services Act (DSA) – which took effect for major platforms in 2023-2024 – directly tackles the online platform environment where much algorithmic persuasion happens. For example, if a social media app tried to hide the option to opt out of targeted ads behind multiple sub-menus (a classic dark pattern), that could be deemed non-compliant with the DSA’s requirements for clarity and fairness.

Secondly, the DSA introduces transparency obligations for recommender systems. Platforms must explain to users, in plain language, the “main parameters” of how their recommendation algorithms work. This means services like Facebook, Instagram, or YouTube have to disclose the general logic behind what content gets shown to you (e.g. does it depend on your past likes, your location, popularity of posts, etc.). Additionally, if options exist to personalize or alter the feed, those should be made easily accessible. The idea is to lift the hood on the algorithmic black box a bit, so users aren’t completely in the dark about why they’re being shown something.

Going a step further, Article 38 of the DSA requires very large online platforms (VLOPs) like Meta, TikTok, etc., to give users a way to opt out of personalized recommendations. Specifically, they must provide “at least one option for each recommender system that is not based on profiling”. In practice, this has led to platforms offering chronologically sorted feeds or “unpersonalized” views. By late 2024, we saw companies start to comply: Facebook and Instagram introduced a chronological feed option, and TikTok added a toggle to view a non-tailored feed, as a direct response to the DSA. This is a huge change – it gives users an escape hatch from the algorithmic bubble if they want it. While many users might still prefer the personalized feed (since it can be more engaging), the presence of choice is a win for autonomy.

Another crucial aspect of the DSA is the focus on systemic risks of algorithms. The largest platforms have to assess and mitigate risks such as the spread of disinformation, effects on mental health, or addictive usage patterns. The DSA even flags “risks related to … users’ addiction” as something platforms must consider and reduce if possible. This directly targets the kind of engagement-maximizing nudges that could lead to unhealthy usage (like infinite scroll and constant notifications). Platforms might, for instance, need to adjust their design (e.g., adding “take a break” prompts or limits) if their risk assessments show a substantial addiction risk. In essence, the DSA pushes tech companies toward more transparency and user control, and less sneaky manipulation in how they run their services.

GDPR and Data Privacy: Consent to Profiling

While the AI Act and DSA are newcomers, the General Data Protection Regulation (GDPR) has been in force since 2018 and plays a foundational role in governing algorithmic persuasion from a data privacy perspective. Whenever AI nudges rely on personal data (which is almost always – consider that these algorithms profile your behavior, preferences, etc.), GDPR becomes relevant.

Transparency and consent are core GDPR principles: individuals should be informed about what data is collected and how it’s used to profile them. They often must consent to uses of their data beyond what’s strictly necessary. This is why, for instance, websites in Europe incessantly ask for consent to cookies and tracking – it’s an attempt to comply with data laws for personalized ads.

If an AI is nudging you based on your personal data (browsing history, purchase history, etc.), GDPR implies you ought to have been informed and given a choice about that profiling. Using personal data to “evaluate personal aspects” or “predict behavior” is literally in the GDPR’s definition of profiling, and such activities must have a valid legal basis (like consent or legitimate interest with a chance to opt-out). For example, Facebook’s use of your activity to curate your feed or target ads is subject to GDPR; this led to multiple legal challenges about whether users truly consented to such profiling or were essentially forced into it as a condition of service. The GDPR also emphasizes data minimization and purpose limitation – meaning companies should not collect more data than necessary, nor use it for purposes the user wasn’t aware of. Those principles indirectly combat overly intrusive algorithmic persuasion by limiting the data fuel these algorithms have, unless users explicitly agree.

Finally, GDPR intersects with manipulation concerns through fairness and transparency requirements. The law doesn’t explicitly say “you can’t manipulate users,” but it does say processing of personal data should be fair and transparent. If a practice is so manipulative that it dupes the user, can it really be called fair or transparent? Arguably not. Data protection authorities in Europe have also taken up the fight against deceptive design: for instance, the European Data Protection Board issued guidelines on “dark patterns” in social media privacy settings, calling out designs that undermine or trick users’ consent choices.
